This is so wrong :mad: the poor bloke was merely defending himself from being killed.

shopkeeper could face a murder charge following a fatal struggle with a knife-wielding raider.

Tony Singh fought back when Liam Kilroe, a career criminal, ambushed him in his car after closing time.

Kilroe, who was trying to steal Mr Singh's takings, staggered away with a stab wound from his own knife and died in a pool of blood.

The 25-year-old was on the run after being charged with two robberies.

Police called to the scene found Mr Singh in a state of shock, still sitting in his car and nursing serious knife wounds to his back, face and neck.

However, the officers arrested the 34-year-old and are preparing to send a file to the Crown Prosecution Service.

A murder charge would carry a life sentence on conviction.

The case resembles that of Tony Martin who was charged with murder after shooting Fred Barras, 16, during a raid on his Norfolk farm in 1999.

He was convicted of manslaughter and served three years in prison.

And last month, three youths were jailed for murdering Garry Newlove, a father of three who confronted them over damage to his wife's car.

Kilroe appeared at the window of the businessman's Ford Focus, smashed it with the butt of his knife and demanded the takings.

Mr Singh fought back and during the struggle the knife went into Kilroe's chest. A post-mortem examination revealed he had died of a single stab wound.

After his arrest, Mr Singh was taken to hospital where his wounds were stitched up.

He was then questioned for several hours at a nearby police station. Mr Singh is believed to have told senior officers the knife went into Kilroe's chest by accident.

He was released on police bail in the early hours of Monday morning.

Mr Singh - who has run his store, Lifestyle Express, for several years - is a popular member of the community and is known for his hard work and friendly nature.

Residents say he works a 13 or 14-hour day at the shop and that he and his family have lived in the town for many years.

Mr Singh was freed on police bail after witnesses gave "consistent accounts" claiming Kilroe had attempted to rob Mr Singh.

They said the criminal had been stabbed with his own knife.

Last night, Mr Singh showed off the injuries to his face, neck and lip. "I feel lucky to be alive," he said. "All I was doing was trying to stop myself getting hurt.

"The guy could have killed me. I've got some injuries to my face and I'm pretty shaken up but thankfully I am OK and able to return to work.

"It could have been so much worse. If one of the wounds had gone one inch either way then it could have been fatal for me."

Lancashire Police confirmed a file had been sent to the Crown Prosecution Service for lawyers to consider whether murder, manslaughter or assault charges should be brought against Mr Singh.

It has emerged that Kilroe, who comes from Skelmersdale, was a serial criminal with a record of violence and robbery dating back nine years to when he was a teenager.

He had multiple convictions for raiding stores in his town.
Incredibly, he had been given bail last year despite pleas that he remain in custody after the collapse of his trial for two robberies.

Lancashire Police issued a warrant for his arrest last week after he failed to appear in court. He was on the run when he targeted Mr Singh's late-night shop.

Mr Singh has been given bail until February 29 pending further police inquiries.

One of his customers said: 'I'm not saying the robber deserved to die but if you come at someone with a knife and end up getting stabbed, you've only yourself to blame.

"Obviously no one could have predicted the tragic outcome.

"Mr Singh and his family are extremely valuable and well-liked members of this community, which is more than can be said for Kilroe."

A local shopkeeper said: "Armed robbers don't expect their victims to fight back and maybe others will now think twice about committing such dreadful crimes in the future."

Detective Superintendent Mick Gradwell, who is leading the inquiry, said: "Police and ambulance attended the scene at around 9pm on Sunday and found the driver and passenger windows of the Focus smashed.

"Liam Kilroe was dead by the car and another man, who we can't name, was in the car with stabbing injuries to his head and back.

"There had clearly been a struggle between the two men and we have recovered a knife which I believe to be Liam Kilroe's. We have had a number of consistent accounts from eye witnesses to the incident and further inquiries will be made."

The shopkeeper should be allowed to waste him i reckon...there should be a set of guidelines regarding how shopkeeper can legally defend themselves even if it means takin a criminal's life.

its a shame that the shop-keeper is gonna get some time for 'defending himself' even after taking 3 wounds :no:

doubt he'd get Murder. Manslaughter if he has a shit Lawyer. Even Assault is harsh.

Personally i think he should be knighted!

he's not going to jail they just have to put him through the process cause the law requires it to, no dumb judge will put him in jail its a clear case of self defence. But they need to change the law to not arrest the guy when he defending himself but probably keep it to make sure it was self defence.

I think its high time that self defence of one's own life is paramount in law than that of the aggressor who is trying to do you harm.
