I think the OP might be referring to the fact that India does not have a uniform civil code with respect to its various religious communities. For example, I don't think Muslims are governed by the common law when it comes to matters such as divorce, marriage, or inheritance, and may apply Islamic law in those areas. But this old news.

Everyone is, of course, governed by the same penal code.

the only valid objection here is that it is even called "Hindu" Personal Law. the reality is that it is virtually identical to English law - the same law that was used to govern both Hindus and Sikhs together by the British.

there is nothing Hindu about any of it.

the reason why there even exists separate civil codes is because Muslims have their own civil code in India. there is essentially the muslim code and the "everybody else" code, and that ends up being called the "Hindu" code.

to further pry it up and say "sikh code" or "jain code" will directly work against the gradual movement and strong lobby towards having a uniform civil code, like a sane secular nation should. furthermore, a Sikh personal law code would a) be the same English law as the "Hindu" code, and b) directly worsen separation of religion and state efforts. Ultimately, all these codes will change from "Hindu", "Muslim", etc. simply to "Indian civil code" with uniform laws for all the people. Muslims will surely object, but that is the only way for a secular nation to operate.

the only valid objection here is that it is even called "Hindu" Personal Law. the reality is that it is virtually identical to English law - the same law that was used to govern both Hindus and Sikhs together by the British.

there is nothing Hindu about any of it.

the reason why there even exists separate civil codes is because Muslims have their own civil code in India. there is essentially the muslim code and the "everybody else" code, and that ends up being called the "Hindu" code.

to further pry it up and say "sikh code" or "jain code" will directly work against the gradual movement and strong lobby towards having a uniform civil code, like a sane secular nation should. furthermore, a Sikh personal law code would a) be the same English law as the "Hindu" code, and b) directly worsen separation of religion and state efforts. Ultimately, all these codes will change from "Hindu", "Muslim", etc. simply to "Indian civil code" with uniform laws for all the people. Muslims will surely object, but that is the only way for a secular nation to operate.

the separate civil codes are the one glaring exception to India's otherwise stellar separation of church and state and its secular constitution. the only other notable blemish is the ban on cow slaughter in certain states, although this is at least done at state-level rather than federal.

uniform civil code = good.

I hope the drumbeat for a uniform civil actually does lead to one in the near future. It's an embarassing state of affairs when all the citizens of one country are governed by two sets of laws.
